COVID EMERGENCY ORDER

IN THE MUNICIPAL COURT OF TOLEDO, LUCAS COUNTY, OHIO

 In order to ensure the safety of court staff and citizens before the Court and in accord with JE 20-COVID-001, the Court is temporarily enacting the following:

Continuing Operations.  All felony and in-custody cases will continue as scheduled.

Building Entry and Security.  Toledo Municipal Court will be closed to the public except for any individual (defendant, witness, victim, attorney) with a scheduled case.  Deputies will enforce social distancing protocols.  Persons who are ill will not be permitted in the building. 

Fines and Costs.  All fines, fees, and costs that are due between March 11, 2020 and June 1, 2020 shall be continued an additional 90 days from the original due date.  Effective March 17, 2020 payment of fines, costs and fees can only be made via online payment or by phone. 

Traffic Cases.  Effective Tuesday, March 17 all traffic cases will be cancelled and reset to after June 1, 2020.  This includes all arraignments (first appearance), pre-trials, and trials on all traffic (TRD).  Traffic (TRD) probation violation hearings will be cancelled and reset. This is until further notice.

OVI Cases/TRC Cases.  Effective Tuesday, March 17 all Operating a Vehicle Under the Influence (TRC) cases between March 17, 2020 and March 31, 2020, with the exception of arraignments, will be cancelled and reset to after April 1, 2020.  OVI (TRC) probation violation hearings will be cancelled and reset.

Jury Trials.  No jury trials will take place through the end of March

Misdemeanor Criminal Cases.  Effective Tuesday, March 17 all non-violent cases scheduled through the end of March will be cancelled and reset.  The following case types will proceed as scheduled:

Domestic Violence, Assault, Child Endangering, Child Enticement, Aggravated Menacing, Unlawful Restraint, Menacing, Violations of TPO, Telephone Harassment, Vehicular Homicide and any attempt, complicity or conspiracy to commit any of the forgoing offenses.  Any Sexually Oriented Offenses, including Attempted Importuning, Sexual Imposition, Unlawful Sexual Conduct with a Minor, and Voyeurism, Attempted Illegal use of a Minor in Nudity Oriented Material or Performance, Attempted Child Enticement with Sexual Motivation, Attempted Pandering Obscenity, Menacing by Stalking with Sexual Motivation, Unlawful Restraint with Sexual Motivation, and any attempt, complicity or conspiracy to commit any of the forgoing offenses

Probation Reporting.  All probation reporting will take place by telephone.
